摘要: 按照法律和政策的基本精神,我国的土地承包关系将在第二轮承包期限届满后再延长三十年。这一做法建立的是一种新的土地承包关系,原承包方取得新的土地承包经营权,只有具备集体经济组织成员身份并享有土地承包经营权的农户才有主体资格。因此,进城落户的承包户、弃耕抛荒的承包户具有参与第二轮承包期限届满后再延长三十年的主体资格,而交回承包地的承包户则不具有主体资格。发包方与承包方应当续订承包合同,但土地承包经营权证在新的承包期限内继续有效。第二轮承包期限届满后再延长三十年后,“三权分置”中的土地经营权在流转期限内继续有效,相应的土地经营权抵押亦不受影响。承包地依法可以进行调整,但原无土地承包经营权的农户通过签订承包合同取得新的土地承包经营权,不属于第二轮承包期限届满后再延长三十年的调整范围。

Abstract: In accordance with the fundamental spirit of laws and policies, the land contract relationship shall be extended for another 30 years upon the expiration of the second round of land contract periods. The 30-year extension establishes a new land contract relationship, under which the original contractor acquires a new right to land contractual management. When implementing the 30-year extension after the expiration of the second round of contracting periods, only rural households that are members of the collective economic organization and hold the right to land contractual management shall possess the eligibility to participate. Contractors who have relocated to urban areas upon household registration transfer, as well as those who have abandoned or left their contracted land uncultivated, retain their eligibility to participate in the 30-year extension. By contrast, households that have voluntarily returned their contracted land shall not be eligible. Upon carrying out the 30-year extension, the contractawarding party and the contractor shall renew the land contract; however, the certificate for the right to land contractual management shall remain valid throughout the new contracting period.
