平台治理应走出“结果中心”困局——基于“幽灵外卖”问题的反思

Platform Governance Should Break Out of the “Outcome-Centered” Dilemma:Based on the Reflection of the “Ghost Delivery” Issue

摘要: 既有法律法规对于“幽灵外卖”等平台存在的问题的治理多以“结果中心”为导向,过度倚重事后惩戒,因此面临规制滞后、责任虚化和激励错位的困局。鉴于此,亟需推动网络平台治理范式转型,转向侧重于对平台经济领域各市场主体经营行为的持续性治理,即“过程中心”的治理范式。“过程中心”治理范式通过强化全流程的动态监管与风险预防,能够更早识别并阻断各种风险隐患,故能较大程度上弥补“结果中心”治理范式的不足。实践中,可通过构建入网准入的过程性实质核验机制、持续过程性风险监测制度、治理过程的程序商谈机制等制度,为网络平台治理走出“结果中心”困局提供规范依据和实践方案。

Abstract: The existing regulation of platform alienation business behaviors such as “ghost delivery” relies on the “outcome-centered” governance paradigm, which is overly reliant on post-event punishment and terminal outcomes. Currently, it faces dilemmas such as regulatory lag, responsibility ambiguity, and incentive misalignment. In light of this, there is an urgent need to promote the innovation of governance paradigm for online platforms, shifting towards a paradigm that focuses on continuous process-oriented governance of the business behaviors of various market entities in the platform economy, namely the “process-centered” governance paradigm. As the “process-centered” governance paradigm can identify and block various security risks earlier by strengthening dynamic supervision and risk prevention throughout the entire process, it can largely compensate for the governance dilemmas of the “outcome-centered” paradigm. In practice, by establishing systems such as a process-oriented substantive verification mechanism for network access, a continuous process-oriented risk monitoring system, and a procedural negotiation mechanism in the governance process, we should provide normative basis and practical methods for the governance of platforms beyond the dilemma of “outcome-centered”.
