摘要: 李泽厚先生的“儒法互用”讨论传统中国政治转型的模式,突出在法家化的制度与法律基础上,融入儒家之“礼”与“人情”,在价值层面范导制度的精神与自我完善。其核心是一种“先法后礼”式的制度逻辑,这与荀子对秦国政治前景的研判有深度共鸣,但李泽厚或许并未关注这一点。他以新一轮“儒法互用”为现代中国民主法治进程的隐患未雨绸缪,但其主张“举孟旗行荀学”以重建“人情”,只能应对社会中的人伦失范,与其批评官僚制以“人情”妨害法治与公德的问题并不对症。若对李泽厚观点本身进行“转化性创造”,提出“举荀旗行韩学”,以凸显荀子式公共道德对韩非式官僚制严法秩序的范导作用,两者便可分别观照社会人伦与制度规范的改进。这样既能补充李泽厚的“儒法互用”理论体系,也能更好地借助这一理论阐发中国政制的传统话语。
Abstract: Mr. Li Zehou’s discussion of the “integration of Confucianism and Legalism” (rufa huyong) addresses the model of political transformation in traditional China. It highlights how, on the foundation of Legalist-style institutions and laws, Confucianli(ritual) andrenqing(human sentiment) are integrated to normatively guide the spirit of the system and its self-perfection at the value level. At its core lies an institutional logic of “law preceding ritual” (xian fa hou li), which resonates deeply with Xunzi’s assessment of the political prospects of the Qin state, although Li Zehou himself did not attend to this connection. He invokes a renewed “integration” to preemptively address potential pitfalls in the democratic and legal development of modern China. However, his proposition of “raising the Mencian flag but practicing Xunzian learning” to rebuild renqing can only address ethical anomie in social relations; it fails to target the very problem he criticizes-namely, that renqing within the bureaucracy obstructs the rule of law and public morality. If we apply a “transformative creation” to Li Zehou’s own thesis and propose “raising the Xunzi’s flag but practicing Han Fei’s learning”, highlighting how Xunzi-style public morality normatively guides the strict legal order of a Han Fei-style bureaucracy, the two approaches can respectively attend to the improvement of social ethics and institutional norms.
