AI 时代的法律权利可让渡吗——与朱赫夫、舒国滢商榷

Can Legal Rights Be Transferred in the AI Era: A Discussion with Zhu Hefu and Shu Guoying

摘要: 生成式人工智能对法律人的冲击引发了学界对“法律人是否会被 AI 替代”的持续论争。朱赫夫、舒国滢的研究突破了“简单案件可替代、疑难案件不可替代”的固化范式,从技术底层逻辑论证生成式人工智能模拟疑难案件处理中等置模式的可能性,提出了其将对法律人构成真正挑战的论断,将该领域研究推进至法律思维模式与技术底层逻辑的深层对话层面。但是,通过对法律人本质与技术应用边界的系统剖析发现,生成式人工智能只是赋能法律作业流程,并未动摇法律权利不可让渡的核心内核;技术功能的可模拟性不等于职业本身的可让渡性,法律人的合法性根基并非基于法律技术的垄断,而是源于法治实践的主体性担当与公共责任。技术变革不会消解法律人,反而将推动法律人摆脱事务性工作的束缚,回归职业价值本质。

Abstract: The impact of generative AI on legal professionals has sparked an ongoing academic debate over whether legal professionals will be replaced by AI. Zhu Hefu and Shu Guoying’s research breaks through the entrenched paradigm that “simple cases can be replaced, while complex cases cannot”. By examining the underlying technical logic, they demonstrate the possibility of generative AI simulating the “equivalence model” in handling complex cases, proposing the significant conclusion that this will pose a genuine challenge to legal professionals, thus advancing research in this field toward a deep dialogue between legal thinking patterns and the underlying logic of technology. However, through a systematic analysis of the essence of legal professionals and the boundaries of technological application, it is found that generative AI can only empower legal workflows and does not undermine the core, non-transferable essence of legal rights; the simulability of technological functions does not equate to the transferability of the profession itself. The legitimacy of legal professionals does not rest on a monopoly over legal technology, but rather on their active role in the practice of the rule of law and their public responsibility. Technological transformation will not render legal professionals obsolete; rather, it will liberate them from the constraints of routine administrative tasks, allowing them to return to the essence of their professional value.
