摘要: 数字时代的法律知识流动媒介从纸质载体转变为数字生态,流动逻辑从“自上而下”转为“自下而上”。在这一转型中,数字化存储与检索革新了法律知识的存储形态,数据与算法推动法律主体实现数字化交互,使法律知识的易获取性与互动性显著提升,但也伴随着流动主体多元、内容系统升级等新特征。法律知识的数字化流动依托多元主体的共同作用,即权威机构保障知识权威性、法律受众主动推动知识流动、第三方机构以商业逻辑赋能流动。同时,这一过程受科技主义、经济主义与实用主义三重逻辑驱动,并应回应算法规制、知识产权保护与法律规制等核心命题。为保障法律知识数字化流动的安全有序,需构建智能化互动、场景化应用与法治化系统结合的综合规制路径,在发挥数字技术优势的同时,坚守数据安全与司法正义底线,推动法律知识流动更好地契合数字时代的法治建设需求。

Abstract: In the digital age, the flow medium of legal knowledge has shifted from paper carriers to a digital ecosystem, and the flow logic has changed from a “top-down” approach to “bottom-up”. In this transformation, digital storage and retrieval have revolutionized the storage form of legal knowledge, while AI and algorithms have enabled digital interaction between legal subjects, significantly enhancing the accessibility and interactivity of legal knowledge. However, this also introduces new features such as diversified flow subjects and upgraded content systems. The operation of the digital flow of legal knowledge relies on the joint action of multiple subjects: authoritative institutions ensure the authority of knowledge, legal audiences actively promote knowledge flow, and third-party institutions empower the flow through commercial logic. Meanwhile, this process is driven by the triple logics of technologism, economism, and pragmatism, and must address core issues such as algorithmic regulation, intellectual property protection, and legal regulation. To ensure the safe and orderly digital flow of legal knowledge, it is necessary to construct a comprehensive regulatory path that integrates intelligent interaction, scenario-based application, and a law-based system, so as to leverage the advantages of digital technology while upholding the bottom line of data security and judicial justice, thereby promoting the flow of legal knowledge to better meet the needs of rule-of-law construction in the digital age.
